These terms and conditions govern the services provided by JKay Web Design Co. to its clients. By engaging our services you agree to the following terms in full.
About Us JKay Web Design Co. is a sole trader web design business based in County Durham, England. We provide website design, monthly retainer, e-commerce setup, email marketing and ongoing maintenance services to clients across the local area and beyond.
Our Services
Website Design We design and build websites using third party website builder platforms including Wix and IONOS. We are a web design service and not a web development agency. All websites are built using no code platforms and this is made clear prior to any agreement being entered into.
Monthly Retainer Retainer packages provide ongoing support and minor updates to your website following launch. Each retainer includes up to 30 minutes of update time per calendar month. Time does not roll over from one month to the next. Any work exceeding the monthly allocation will be charged at our standard hourly rate.
E-Commerce and Payment Gateway Setup We will configure e-commerce functionality and payment gateway integrations such as Wix Payments, Stripe or PayPal as part of the agreed scope of work. The client is solely responsible for entering and verifying their own banking and financial information within the payment processor. JKay Web Design Co. does not handle, store or access any client banking or card details at any point.
Email Marketing and Newsletters Where agreed, we will set up email marketing and newsletter functionality within your website and provide guidance on managing it independently. The client is responsible for ensuring all email marketing activity complies with UK GDPR and the Privacy and Electronic Communications Regulations (PECR).
Ongoing Maintenance and Updates Maintenance and update work outside of a retainer agreement will be quoted and agreed in writing before work begins and charged at our standard hourly rate.
Client Responsibilities The client agrees to provide all content required for the website including text, images, logos and any other media in a timely manner. Content should be provided within 7 days of being requested. Delays caused by late content provision may extend the project timeline without affecting the agreed fees.
The client confirms they own or have the legal right to use all content provided to JKay Web Design Co. Any legal issues arising from the use of client supplied content are the sole responsibility of the client.
The client is responsible for reviewing and approving work at each agreed stage. Approval given at any stage is considered confirmation that the work meets the agreed requirements.
Fees and Payment All fees are agreed in writing prior to work commencing. A 50 percent deposit is required before any work begins. The remaining balance is due upon completion and before the website goes live. Monthly retainer fees are due on the first of each month.
We reserve the right to suspend or take offline any website where payment is more than 14 days overdue. Overdue accounts may be subject to a late payment charge in accordance with the Late Payment of Commercial Debts Act 1998.
All prices are quoted in pounds sterling and are inclusive of any applicable taxes unless stated otherwise.
Refunds and Cancellations The deposit paid prior to commencement of work is non-refundable in all circumstances. If the client cancels a project after work has begun, payment is due for all work completed to date at the agreed hourly rate. If JKay Web Design Co. is unable to complete the project for any reason, a pro-rata refund will be issued based on the work completed.

Either party may cancel a monthly retainer agreement with 30 days written notice. No refunds will be issued for retainer months already paid.
Intellectual Property and Ownership Upon receipt of full and final payment, ownership of the completed website design passes to the client. JKay Web Design Co. retains ownership of all design work until payment has been received in full.
The client is responsible for maintaining their own platform account and all associated subscriptions. JKay Web Design Co. accepts no responsibility for any loss of access, data or functionality resulting from the client failing to maintain their platform account.
Use of Portfolio and Testimonials JKay Web Design Co. reserves the right to display completed websites in our portfolio and use them for promotional purposes including on our website and social media channels. If you do not wish for your website to be featured in our portfolio please notify us in writing prior to signing any agreement. We may also request a testimonial following project completion. Providing a testimonial is entirely optional.
Limitation of Liability JKay Web Design Co. is not responsible for any issues arising from third party platforms used to build or host your website, including outages, price changes, feature changes or platform discontinuation. Any such issues should be raised directly with the platform provider.
JKay Web Design Co. is not liable for any loss of revenue, loss of data, loss of business or any indirect or consequential loss arising from the use of or inability to use the website. Our total liability in any circumstances is limited to the total fees paid by the client under the relevant agreement.
Governing Law These terms and conditions are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to These Terms JKay Web Design Co. reserves the right to update these terms and conditions at any time. Any changes will be published on this page with a revised date. Continued use of our services following any update constitutes acceptance of the revised terms.
